GENERAL PROVISIONS
These Terms and Conditions (“Terms”) govern the use of the online platform Photoshootrome.com (also “Platform”). These Terms apply both to clients (also “Users”) and to photographers and videographers. There is an additional document (“Terms and Conditions for Photographers”) that needs to be agreed by the Photographer before the photoshoot.
Your access and use of the Platform constitutes your agreement to be bound by these Terms, which establishes a contractual relationship between you and Photoshootrome.com. If you do not agree to these Terms, you may not access or use the Platform.
– “User” (also “client”) means a person who is interested in photo or video session
– “Photographer” means independent provider of photography services.
www.photoshootrome.com is an online platform where Users plan and arrange photo or video sessions with Photographers. Custom packages can be agreed with client as well.
Photoshootrome.com does not provide any photography services. Photography services are provided by Photographers, who are not employees of Photoshootrome.com. Photoshootrome.com acts solely as a platform that offers the Photographer the possibility to use this online platform to market his/her services. The contract for photography services is formed between the Photographer and the User.
Photographer declares that he/she holds all the permissions and authorizations necessary to provide photography services (if such permissions and authorizations are required by the applicable law), alternatively, Photographer declares, that he/she is legally allowed to provide photography or videography services on an occasional basis (not as a businessperson) if this is allowed by the applicable law.
The booking and inquiry are made by the “booking form” directly on the website (the user can alternatively send an inquiry via email, WhatsApp, etc) by the client. User is invited to pay via payment gateway or cash if needed.
CANCELLATION POLICY
In case you will not be able to attend the photoshoot please contact us as soon as possible and we will do our best to rearrange the date of photoshoot however we cannot guarantee that Photographer would be free on another date/time.
If photoshoot is canceled due to Photographer’s fault, we will fully refund you. Please note that we will always try to do our best to reschedule your photoshoot so there will be no need for cancellation fees.
Notification of cancellation from the User:
If you need to cancel for any reason, please email or call us and we will refund 100% of your booking fee as long as you provide us no less than 7 days’ notice prior to your scheduled shoot date.
Within 7 days, once the shoot date and time are confirmed you may ask for a 50% refund; we will retain the 50% balance for processing and handling fees.
Within 24h of the shoot date and time, all sales are final and there is no refund for cancelled shoots. Please visit our Terms & Conditions for complete details regarding our cancellation policy.
All sessions can be rescheduled due to bad weather conditions or other unforseens. In this case if it will not possible to reschedule you will receive a total refund
Photoshootrome.com is not responsible for and will not reimburse any additional fees charged to the client by his/her bank/card provider or paypal for receiving above specified refund.
There’s no reimbursement of the money if the client doesn’t show for the photo shoot. If the client comes late to the photo shoot we can’t guarantee that the photo shoot will be prolonged.
PAYMENT POLICY
The binding prices are in EUR (Euro). Photoshootrome might show indicative prices in other currencies on the website. Please note that the final price will be always shown and charged in EUR.
We do not have any control over the foreign exchange rates set by banks and bear no responsibility for the foreign exchange conversion rates used by the payment gateway, paypal, your bank or payment card provider.
DELIVERY OF PHOTOS / VIDEOS
By using our photography services, you agree to receive edited and carefully chosen photos promptly from the photographer. To speed up the process and ensure a quick delivery within a few days, we do not offer clients the option to personally pick the photos. However, if you’d like, you can add the option to choose photos during the booking as an additional service. Rest assured that our experienced photographer will expertly curate and deliver high-quality images for your satisfaction.
ACCIDENT
By booking a photo shoot with Photoshoot Italy you waive or waive certain legal rights, including the right to claim compensation following an accident, now or in the future. You agree to waive all claims, and release Photoshoot Italy and the Photographer from all liability and agree not to sue Photoshoot Italy and the Photographer, which may be a company, for any personal injury, death, property damage or other loss I suffer during or as a result of a Photoshoot Italy photo session. You as a customer, hereby agree to the following:
1. To waive all claims I have or may have in the future against Photoshoot Italy and the Photographers, and release Photoshoot Italy and the Photographers from any and all liability for any loss, damage, expense or injury including death I may suffer or that my next of kin may suffer as a result of my participation in Photoshoot Italy photography sessions, whether due to any cause whatsoever, including negligence, breach of contract, or breach of any legal or other duty of care on the part of Photoshoot Italy and/or of the photographer.
2. To hold Photoshoot Italy and the photographers harmless from any and all liability for any property damage or personal injury to any third party arising out of my participation in any photography activity or any activity related to the photographic service, which could include walking, hiking, climbing, getting on a boat , or other activities related to the photo shoot;
COPYRIGHT
User has the rights to use all delivered photos for personal and non-commercial use only. User could e.g. print the photos, share with friends etc. Photographer retains copyright for the photos. We will never sublicense or sell your photos (we might do so but we’ll always ask you for your explicit consent before doing so). We reserve the right to use the photos for promotional purposes on Photoshootrome.com, Photoshootrome’s social media profiles, printed materials, articles about Photoshootrom on third party publishers (both online and offline magazines, blogs etc), paid ppc campaigns etc – we will always ask you for publishing permission first!
User could inform us anytime that he or she does not agree with such usage and we would never use the photos in such way.
COMPLAINTS POLICY
By booking the service you agree that you are familiar with the style of your chosen Photographer and you agree to receive photos in such style and quality. In case of any problem with the photo please contact Photoshootrome.com immediately so we could handle the complaint as soon as possible. We will do our best to solve the issue.
We have no control over via maior, extraordinary circumstances and weather conditions. Photo shoots could take place in any weather conditions since our Photographers are professionals and could suggest locations where it is possible to shoot in the rain etc. Sometimes rainy photo shoots are even more original, extraordinary and interesting than traditional “sunny days” photo shoots. However we will try to rearrange (with no guarantee) day and time of the photo shoot if there is bad forecast for the day of the photo shoot.

ADDITIONAL PRODUCTS AND SERVICES
Photoshootrome may offer the client additional products such as express delivery, makeup, etc. Photoshootrome may offer the client additional services such as delivery of flowers to the place of photo shoot etc. Such products or services are arranged and agreed with the client on ad hoc basis.
GOVERNING LAW
These Terms and conditions and the provision of Photoshootrome.com services shall be governed by the law of Italy, Europe. Any dispute arising out of these Terms and conditions and our services shall exclusively be submitted to the competent Italy courts.
These terms apply to all bookings starting from May 7, 2022.
